Distance Contract of laceny.it
1. Scope
1.1. This Distance Contract applies to purchases made by consumers within the European Union through the online shop laceny.it (hereinafter – the Shop).
1.2. The Contract is concluded between the Customer and ApexGlobal SIA (reg. no. 40203313036, legal address: “Ābeļi”, Priekuļu pag., Cēsu nov., LV-4154, Latvia).
1.3. The Distance Contract is valid from the moment the Customer places an order in the Shop and receives an order confirmation by email.
2. Right of Withdrawal
2.1. In accordance with Directive 2011/83/EU on consumer rights and Latvian consumer protection laws, the Customer has the right to withdraw from the purchase within 14 days without giving any reason.
2.2. The withdrawal period expires after 14 days from the day the Customer or a third party indicated by the Customer (other than the carrier) has received the goods.
2.3. To exercise the right of withdrawal, the Customer must notify the Shop in writing by email to: [email protected].
2.4. The Customer may use the standard withdrawal form provided by the Shop, but it is not mandatory.
3. Effects of Withdrawal
3.1. If the Customer withdraws from the purchase, the Shop will refund all payments received, including delivery costs (except for additional costs arising if the Customer chose a delivery method other than the least expensive standard delivery offered by the Shop).
3.2. Refunds will be made without undue delay and not later than 14 days from the day on which the Shop receives the returned goods.
3.3. Refunds will be made using the same payment method the Customer used for the initial transaction, unless otherwise expressly agreed.
4. Return of Goods
4.1. The Customer must return the goods to the Shop without undue delay and in any event not later than 14 days from the day on which the withdrawal was communicated.
4.2. The Customer bears the direct cost of returning the goods, except where the goods were delivered incorrectly or are defective.
4.3. Returned goods must be unused, undamaged, and in their original packaging (as far as reasonably possible).
5. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:
Goods made to the Customer’s specifications or clearly personalized.
Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
Goods which, after delivery, are inseparably mixed with other items.
Digital content delivered electronically, if the Customer has expressly consented to the beginning of performance before the withdrawal period ends.
6. Warranty and Consumer Rights
6.1. The Customer retains statutory consumer rights under EU and Latvian law.
6.2. The Shop provides a warranty for goods as stated in the General Terms and Conditions.
7. Dispute Resolution
7.1. Disputes relating to this Distance Contract shall be resolved in accordance with the laws of the Republic of Latvia and applicable EU legislation.
